RTI : Detail procedure of RTI in WB

The procedure for getting the copies of exam papers which are written by the respective students involve no complex procedures.

The procedure:
Prepare a simple written or typed application stating the intended purpose for seeking information though it is not mandatory. On the top of the Application it must be stated that "APPLICATION UNDER RIGHT TO INFORMATION ACT 2005". The applicant's address and other details must be given in a legible form, though no actual proforma is available. Application Language is English or the official language (Bengali). Affix court fee stamp for the value of Rs.:10/- with the form and please note in the reviewed rules IPO, Non-Judicial Stamp Paper or Demand Draft/Bankers Cheque of same amount can also be granted (people who are belonging to BLP are need not to pay any fee but they should attach their BPL certificate/any proof with the form). If bulk information is sought and the value of the fees is not sufficient then the procedure is that, the concerned authority of the office must reply or notify to the applicant that further amount of fees is being needed and it must be paid through the previously stated any mediums. The application can be send through Regd.-Post with due address to the Public Information Officer of the Concerned Office or Dept. or Institute.


Disposal of request:
General Appeal

If the application is being accepted as Valid it should take 30-35 days from the State Public Information Officer to serve the requested information or the further legal procedure to get it.

First Appeal

If you are not entertained within this 30-35 days period or the SPIO serve you with wrong or incomplete information you can prepare an appeal to the first appellate authority who is an officer senior in rank to the SPIO. Such an appeal should be filled within a period of thirty days from the date on which the limit of 30 days of the supply of information is expired or from the date on which the information or decision of the SPIO is received. The appellate of the public authority shall dispose of the appeal within a period of thirty days or in exceptional cases within 45 days of the receipt of the appeal.

Second Appeal

If the appellate authority fails to pass an order on the appeal within the prescribed period or if the appellant is not satisfied with the order of the first appellate authority, he may prefer a second appeal with the State Information Commission within 90 days from the date on which the decision should have been made by the first appellate authority or was actually received by the appellant.
